“Buyer” means the individual or organisation who buys or agrees to buy the Goods from the Seller;
“Contract” means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions;
“Goods” means the articles that the Buyer agrees to buy from the Seller;
“Seller” means Morningstar Medical Pty Ltd
“Terms and Conditions” means the terms and conditions of sale set out in this agreement and any special terms and conditions agreed in writing by the Seller;

These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.
Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer’s acceptance of these Terms and Conditions.
Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.
Any complaints should be addressed to the Seller’s registered address at P O Box 535, Bedfordview, Johannesburg, 2008.
All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.
Where the Goods ordered by the Buyer are not available from stock the Buyer shall be notified and given the option to either wait until the Goods are available from stock or cancel the order and receive a full refund within 3 days.
PRICE AND PAYMENT
The price of the Goods shall be that stipulated on the Website. The price is exclusive of VAT. The price excludes delivery charges unless the free delivery threshold has been met.
The total purchase price and delivery charges, if any, will be displayed in the Buyer’s shopping cart prior to confirming the order.
After the order is received the Seller shall confirm by email the details, description and price for the Goods.
Payment of the price and delivery charges must be made in full before dispatch of the Goods.
We accept Visa & MasterCard payments as well as EFT.
Our banking details are sent out via email once the order has been confirmed. Card payments are handled by a merchant (PayFast), who use top level encryption to secure your private information as well as fraud checks for your protection and ours.
PayFast makes every effort to ensure the security and integrity of your account and we make use of sophisticated systems to accomplish this. You understand however, that there is a compromise made between the extent of these security systems and the inconvenience to you, the user.
You understand that security still relies heavily on the use of a username and password and undertake to contact us at once if you believe your username and password have been compromised, or if someone has transferred or may transfer money from your account without your permission.
PayFast strongly suggests that you use a web browser with 128-bit encryption or better. However, regardless of whether you use a web browser with security features or not, PayFast is unable to guarantee that data transmitted and is secure and/or will not be intercepted by third parties.
Phishing is a form of fraud where criminals attempt to access your confidential information. This is done by an email request for information, by luring you to a fake website or some other such means. In any case of phishing, PayFast will respond as quickly as possible to alert users to the threat or to mitigate the threat. No guarentee is given as to this action however, and PayFast will not be held liable for any funds lost as a result of a User falling prey to a phishing attack. It is the responsibility of the User to be aware of such potential threats, to avoid them and to report them to PayFast upon discovery.
PayFast reserves the right to implement any security measures deemed appropriate to lower or negate fraudulent transactions, which may result in certain payments a User (as a receiver), or from a User (as a sender), being disallowed.
All information given by you, including your personal details and payment information is completely safe and secure. We also do not sell or give out any of your personal information and contact details to 3rd parties.
Customer details and credit card/payment details are stored seperately by Mornigstar Medical. Credit card information is captured seperately by PayFast, the credit card processing payment gateway. Please visit www.payfast.co.za to view security certificate.
CURRENCY AND TAX
All orders are fulfilled in South African Rand and no VAT is charged.
All of your personal information is confidential. We do not rent, sell, or trade email addresses and personal information. When you place an order with us, we collect your name, address, telephone number, and email address. We use this information for fulfilling your order, and to contact you should there be any problems.
RIGHTS OF SELLER
The Seller reserves the right to periodically update prices on the Website, which cannot be guaranteed for any period of time. The Seller shall make every effort to ensure prices are correct at the point at which the Buyer places an order.
The Seller reserves the right to withdraw any goods from the Website at any time.
The Seller shall not be liable to anyone for withdrawing any Goods from the Website or for refusing to process an order.
The Seller warrants that the Goods will at the time of dispatch correspond to the description given by the Seller.
SHIPPING AND COLLECTION
All orders are shipped after receiving receipt of payment.
Shipment days are Tuesday’s and Thursday’s (Eg: if payment is received on Monday before 13H00, your order will be shipped before 14H00 on Tuesday. If your payment is received on Thursday after 13H00, your order will be shipped before 14H00 the following Tuesday)
Courier Door to Door
We use door to door courier service with
deliveries in South Africa typically taking 1-2 working days in major centers.
Further outlying areas can take up to 5 working days for delivery.
Should you request “door to door” delivery and the area in which the delivery is to take place is not serviced by our couriers, your package will be sent to your nearest post office using Speed service counter to counter.
Speed Service Counter to Counter
Speed Service Counter to Counter operates through the Post Offices in South Africa and orders typically take 1-2 working days to arrive at your nearest post office but can take up to 5 days in more remote areas.
RETURNS AND EXCHANGES
If you would like to return an item, please email email@example.com stating the reason for the return and a return address will be provided.
Given the nature of the products all returns MUST BE unused and unopened (we adhere to strict health and hygiene conditions).
1. The goods must be unused
2. Goods must be in their original condition & packaging.
3. Goods must be received back within 14 days from the day you receive your order.
Please use a courier, as Morningstar
Medical cannot be held accountable for returned items not received back.
All returned items are subject to a 15% restocking fee. Returns are the
responsibility and expense of the customer.
Wrap your return in the same packaging where possible in which you received it and enclose the packing slip. Return via courier (to-door, no post office returns will be collected/permitted).
If we suspect that the goods have been used or any of the above conditions are not met, regrettably we reserve the right to return the goods without notice (and with re-shipping costs being the responsibility of the buyer). Items supplied in sealed packaging that have been opened are non-refundable and non-exchangeable. A full refund will be made within 7 days from cancellation of the order, provided the goods are returned to us in their original condition. (excluding delivery).
Refunds are made via bank transfer to the customer’s designated South African bank account or for store credit where applicable. Notice is given that free offers and our P&P (postage and packaging) costs will be accounted for if returned goods takes the order value below the free offer level. The value of free offer goods will be deducted from any refund that may be due.
To avoid refund deductions please return any free offer goods with your returns if your order value will drop below the free offer level. All Packages returned to us unclaimed via our couriers will be subject to reshipping charges as defined on our delivery page. Wrap your return in the same packaging in which you received it and enclose the packing slip.

CHANGES TO TERMS AND CONDITIONS
The Seller shall be entitled to alter
these Terms and Conditions at any time but this right shall not affect the
existing Terms and Conditions accepted by the Buyer upon making a purchase.
GOVERNING LAW AND JURISDICTION
These Terms and Conditions shall be governed by laws of South Africa and the parties hereby submit to the exclusive jurisdiction of the South African courts.
